Class Deviation 2018-O0007
Small Business Subcontract Reporting

This class deviation rescinds and supersedes Class Deviation 2016-O0009. Effective immediately, contracting officers shall use the attached deviation clauses and alternates, in lieu of alternate IV of the clause at FAR 52.219-9, Small Business Subcontracting Plan, and the basic and alternate I of the clause at DFARS 252.219-7003, Small Business Subcontracting Plan (DoD Contracts). Specifically:

  • For solicitations and contracts that include the basic, alternate I, or alternate II of the clause at FAR 52.219-9, use the deviation clause 252.219-7003, Small Business Subcontracting Plan (DoD Contracts)-Basic (DEVIATION 2018-O0007) provided in Attachment 1.
  • For orders or calls against basic ordering agreements (BOAs) or blanket purchase agreements (BPAs), use Alternate III of the clause at FAR 52.219-9 and the deviation clause 252.219-7003, Small Business Subcontracting Plan (DoD Contracts) Alternate I (DEVIATION 2018-O0007) provided in Attachment 2.
  • When incorporating a subcontracting plan due to a modification to an order under a BOA or BPA, as provided for in FAR 19.702(a)(3)-
    • Use the deviation clause 252.219-7003, Small Business Subcontracting Plan (DoD Contracts)-Alternate I (DEVIATION 2018-O0007) provided in Attachment 2; and,
    • In lieu of Alternate IV of the clause at FAR 52.219-9, use the deviation to the alternate 52.219-9, Small Business Subcontracting Plan-Alternate IV (DEVIATION 2017-O0007) provided in Attachment 3.

The deviations to the basic and alternate I of DFARS clause 252.219-7003 provided in Attachments 1 and 2 change the entity to which the contractor submits the Summary Subcontract Report (SSR) in the Electronic Subcontracting Reporting System (eSRS) for an Individual Subcontracting Plan from the military department or defense agency to DoD.

In addition, eSRS does not currently support the submission of an Individual Subcontracting Report (ISR) for orders placed against BOAs and BPAs. The deviations to alternate I of the DFARS clause and alternate IV of the FAR clause provided in attachments 2 and 3, ensure DoD is able to capture subcontracting data for these orders, by instructing contractors to submit the Standard Form 294, Subcontracting Report for Individual Contracts, to the Contracting Officer, instead of submitting an ISR in eSRS.

This class deviation remains in effect until it is incorporated in the DFARS or otherwise rescinded.
