Increase of Micro-purchase Threshold for Contracts in Support of Hurricane Katrina Rescue and Relief Operations

This class deviation implements Section 101 of Pub. L. 109-62, Second Emergency Supplemental Appropriations Act to Meet Immediate Needs Arising from the Consequences of Hurricane Katrina, 2005. This class deviation-

  • Adds a new paragraph (3) to the definition of "micro-purchase threshold" at FAR 2.101, to read as follows:
  • "Micro-purchase threshold' means $2,500, except it means-

    * * * *

    (3) For acquisitions of property or services determined by the head of the agency to be used in support of Hurricane Katrina rescue and relief operations, $250.000."

  • Makes the requirement at DFARS 213.270(b)(1) inapplicable to micro-purchases that exceed $15,000.
  • Revises DFARS 213.301(3) to read as follows:

    "(3) A contracting officer supporting a contingency operation as defined in 10 U.S.C. 101(a)(13) ...also may use the Governmentwide commercial purchase card to make a purchase that exceeds $15,000 but does not exceed the simplified acquisition threshold, if-"

This class deviation is effective upon signature, and remains in effect for as long as Hurricane Katrina rescue and relief efforts continue, or until otherwise rescinded.
